Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs all access to and use of the BWENDI Location Context API, its associated Gravity Scoring engine, Catchment Tier system, and any spatial JSON payloads delivered through it. By activating an API key, you ("Developer", "Customer", or "Licensee") unconditionally agree to these terms in addition to the BWENDI Terms of Service.

Integrity

Anti-Replication & Database Protection

1.1 No Competitive Benchmarking or Replication

You shall not use the BWENDI API, the Gravity Score, the Catchment Tiers, or any provided spatial JSON payloads to build a competitive product, service, or spatial database that is functionally equivalent to, derived from, or intended to replace BWENDI. This prohibition applies regardless of whether the competitive activity is commercial or academic in nature.

1.2 Scraping Prohibition

You are strictly prohibited from systematically querying the API to map, scrape, or recreate BWENDI's underlying Economic Anchors database or geographic topology. Any algorithmic behaviour designed to harvest coordinates — rather than serve a legitimate, identified end-user application — will result in immediate API key revocation without refund. BWENDI reserves the right to seek injunctive relief and damages for violation of this clause.

1.3 Reverse Engineering

You may not attempt to decompile, reverse engineer, or reconstruct the scoring algorithms, weighting models, catchment geometry definitions, or any proprietary classification scheme embedded within BWENDI API responses. This includes inferring internal algorithms through systematic statistical analysis of returned scores.

Artificial Intelligence

AI & Machine Learning Restriction

2.1 Prohibition on AI Training

Unless a signed Star order form or addendum expressly grants model-training rights, you may not use any data returned by the BWENDI API — including raw JSON payloads, Gravity Scores, Catchment Tier assignments, Economic Anchor metadata, and generated Verification Strings — as training data, fine-tuning data, validation data, or prompt-context input for any artificial intelligence, machine learning model, foundation model, large language model, or autonomous agent network.

2.2 Embedded Intelligence Clause

Where BWENDI data is used to inform the output of an AI-driven interface, dashboard, or report presented to end-users, such usage must remain within the scope of a single user session or query — it does not constitute authorisation to persist, aggregate, or systematically index that output for model improvement pipelines. Any in-session AI interpretation of BWENDI context must be clearly distinguished from raw BWENDI data in your architecture.

Custom Star agreements may include limited model-training rights, subject to strict data-governance terms, audit-logging requirements, attribution obligations, and any use-case restrictions stated in the signed contract. Contact BWENDI to discuss a tailored agreement.

Data Governance

Caching & Data Retention

3.1 Time-to-Live (TTL) Enforcement

The BWENDI API provides real-time, dynamic spatial intelligence. Because stale responses create operational risk, you may cache API responses only for the retention period attached to your active plan: up to 24 hours on Satellite, up to 30 days on Moon, and up to 3 months on Star. Once that window expires, you must delete the cached response or re-query the API before using the data in any downstream decision, display, workflow, or automation.

3.2 No Raw Data Resale

You may use BWENDI data to inform your internal business logic or display contextual information to your direct end-users within a product you have built and own. You may not package, syndicate, sub-license, broker, or resell the raw BWENDI API payloads — in whole or in part — to any third party, data marketplace, or downstream API service, regardless of whether a fee is charged.

3.3 Data Deletion on Termination

Upon termination or expiration of your licence agreement for any reason, you must destroy all cached or stored BWENDI API responses within 30 days. BWENDI may request written confirmation of such deletion. Failure to comply constitutes a continuing breach.

Security

API Key Security & Access Control

4.1 Key Confidentiality

Your API key is issued solely to your registered organisation and may not be shared, published, embedded in public repositories, or transferred to any other entity. You are responsible for all activity originating under your key, whether authorised or not. If you discover or suspect a key compromise, you must rotate the key immediately via the Developer Portal and notify BWENDI within 24 hours.

4.2 No Key Sharing or Resale

You may not distribute, sublicense, or sell access to the BWENDI API to third parties by acting as an intermediary API layer without executing a valid Reseller Agreement with BWENDI. Proxying or relaying BWENDI API calls on behalf of external customers under your own key constitutes a material breach and will result in immediate revocation.

4.3 Environment Isolation

Production and development/test environments must operate under separate API keys. Test-environment traffic must not exceed 5% of your licensed monthly credit volume. Circumventing credit metering through test keys to service production workloads is a breach of this AUP.

Fair Use

Rate Limiting & Platform Stability

5.1 Burst Traffic

You agree not to send traffic volumes that materially exceed your licensed concurrency tier without prior written consent. Burst traffic exceeding 10× your plan's stated concurrency limit — even within total monthly credit allowance — may trigger automatic throttling or temporary suspension to ensure platform availability for all clients.

5.2 Automated Batch Processing

Batch geocoding or coordinate enrichment jobs must be implemented with appropriate inter-request delays. BWENDI recommends no more than 20 concurrent requests per second for bulk operations outside of a pre-agreed bulk-processing arrangement. Unbounded parallel sweeps that destabilise shared infrastructure are prohibited.

5.3 No Stress Testing Without Notice

Load testing, penetration testing, or any form of synthetic stress testing against BWENDI production infrastructure is strictly prohibited without four business days of prior written notice and explicit written approval from BWENDI Engineering.

Prohibited Uses

Absolute Prohibitions

Regardless of your licence tier, the following uses are strictly and unconditionally prohibited:

  • Using BWENDI spatial context to enable, support, or facilitate unlawful surveillance, tracking, or profiling of individuals without their consent.
  • Using BWENDI data in applications designed to discriminate against individuals on the basis of race, religion, gender, disability, national origin, or any other protected characteristic under applicable law.
  • Integrating BWENDI output into systems that facilitate illegal financial activity including but not limited to money laundering, sanctions evasion, or terror financing.
  • Embedding BWENDI API calls within malware, adware, spyware, or any software distributed without the informed knowledge of end-users.
  • Using BWENDI in critical infrastructure control systems (power grids, water treatment, transportation) without a separately negotiated Critical Infrastructure Addendum.
  • Misrepresenting or white-labelling BWENDI data as your own proprietary intelligence in any investor document, government submission, or regulatory filing.

Compliance

Audit Rights & Enforcement

7.1 Usage Monitoring

BWENDI continuously monitors API usage patterns for anomalies consistent with scraping, competitive replication, AI training pipelines, or key sharing. Automated detection of such patterns may trigger an immediate hold on your account pending investigation without prior notice.

7.2 Audit Right

For Star agreements and any higher custom commercial tier, BWENDI may request, on 10 business days' notice, a technical audit of your integration to verify compliance with this AUP. You agree to provide reasonable co-operation, including access to relevant architecture documentation and query logs relating to BWENDI API usage.

7.3 Graduated Enforcement

BWENDI's enforcement posture is proportionate to the severity of the breach: minor or accidental violations may result in a written warning and a 48-hour remediation window; systematic abuse patterns result in immediate key revocation without refund; wilful violations involving competitive replication or unlawful use may result in civil litigation and referral to relevant regulatory authorities.

Governance

Governing Law & Amendments

8.1 Governing Law

This AUP is governed by and construed in accordance with the laws of Switzerland, specifically the Canton of Bern, without regard to its conflict-of-law provisions. Any dispute arising under this AUP shall be subject to the exclusive jurisdiction of the competent courts of Bern, Switzerland, unless a separate arbitration clause applies under your custom agreement.

8.2 Policy Amendments

BWENDI reserves the right to update or modify this AUP at any time. Material changes will be communicated via email to the registered account holder at least 14 days before taking effect. Continued use of the API following the effective date of an update constitutes acceptance of the revised terms. It is your responsibility to maintain a current, valid email address on your account.

8.3 Severability

If any provision of this AUP is found to be unenforceable or invalid under applicable law, that specific provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
